Terms and Conditions

The terms that govern your engagement with Austins for the design, customization, and delivery of bespoke furniture. Please read them carefully before placing an order.


Welcome to Austins. By engaging our services, browsing our website at austins.in, or placing an order with us, you agree to be bound by the terms set out below. These terms govern the relationship between you (the client) and Austins, a bespoke sofa and furniture design studio based in Bengaluru, India.

If you do not agree with any part of these terms, please refrain from using our services. We may update these terms periodically; the version in effect at the time of your order will apply to that order.

1. About Austins

Austins is a sofa design studio specializing in bespoke Italian leather sofas, custom upholstery, soft furnishings, and high-craftsmanship furniture for Indian homes. Each piece is made to order, one project at a time, with meticulous attention to detail.

2. Scope of Services

When you engage Austins, we provide an end-to-end bespoke furniture experience that includes:

  • Design consultation — an initial conversation to understand your space, lifestyle, and aesthetic preferences.
  • Conceptualization — personalized presentations and digital representations for your review.
  • Material selection — collaborative choice of leather, fabric, wood, finishes, and components.
  • Detailed design and specifications — drawings, dimensions, and documentation.
  • On-site inspection and markings — verification by our project head and technical team.
  • Fabrication, assembly, quality assurance, delivery, and installation.
  • Project management — a dedicated project head and design consultant from start to finish.

3. Quotations, Approvals and Order Processing

All quotations issued by Austins are valid for 30 days from the date of issue unless stated otherwise. Order processing begins only after the client or their architect provides final approval of sizes, fabrics, materials, and other specifications, and after the agreed advance payment is received.

Once approval is given and the order is processed, any subsequent alterations to the final product will incur additional charges. Significant alterations that affect aesthetics, functionality, or comfort will be communicated to you before being implemented.

4. Payment Terms

How payments are structured

  • Payee name: All financial transactions — purchase orders, cheques, and account transfers — should be directed to “AUSTINS.”
  • Advance: Manufacturing begins only after design approval and a 75% advance payment.
  • Balance: The remaining 25% must be settled before goods are dispatched.
  • Out-of-town deliveries: Full payment must be received at least 15 days before the scheduled delivery date. Travel arrangements are confirmed only after complete payment is realized.

5. Customization and Natural Variation

Bespoke furniture is, by nature, individual. Slight variations of up to 10% from the reference image or drawing may occur depending on aesthetics, functionality, and comfort at the time of production. This tolerance reflects the handmade character of every piece.

Materials such as leather, wood, stone, fabric, glass, and metal carry inherent variation in colour, texture, and graining. These are intrinsic to the material and not considered defects. By placing an order, you acknowledge and accept this character.

6. Order Cancellation

Once an order has been processed, it becomes non-cancellable. In the event a client wishes to cancel after this stage, the advance amount will be confiscated as per company policy. This is necessary because production, material procurement, and craftsperson allocation begin immediately upon order processing.

7. Warranty

Austins offers a 3-year warranty on all manufactured products, covering structural issues and foam. The complete warranty terms are set out in our Warranty Policy (Exhibit B of your contract). In summary:

  • Covered: Structural defects, foam deformation (not natural softening), and hardware such as drawer channels, bed hydraulics, and furniture legs.
  • Not covered: Natural variation in materials, fabric colour fading from sunlight, atmospheric effects on drawers and shutters, damage from relocation or repacking, third-party remedial work, and damage from use beyond intended purpose.
  • Fabrics: No warranty is provided on fabrics. All fabrics must be dry-cleaned only.
  • Out-of-Bangalore service: Hardware replacement is covered, but uninstallation/installation labour outside Bangalore is chargeable to the client. We provide remote guidance for local labour.
Any remedial work carried out by a third party without prior consultation with Austins will void the warranty.

8. Confidentiality

Both parties agree not to disclose any confidential information shared during the course of the project to any third party without prior written consent. This includes design concepts, project details, financial terms, and any sensitive information exchanged during consultation or execution.

The receiving party will use such information solely for fulfilling obligations under the contract and will implement reasonable measures to ensure only authorized personnel have access.

9. Intellectual Property and Social Media

All design concepts, drawings, and digital representations created by Austins remain the intellectual property of Austins unless explicitly agreed otherwise in writing. We may photograph completed projects for our internal documentation. Photographs of your home will not be shared or posted on any platform without your explicit permission.

Both parties agree to represent each other professionally on social media and to refrain from any actions or statements that could harm the other’s reputation. Any public statement related to the collaboration must be agreed upon in advance.

10. Termination

  • Termination for convenience: Either party may terminate the engagement with 30 days’ written notice. Outstanding obligations must be fulfilled at the point of termination.
  • Breach of contract: If a material term is breached and not remedied within 14 days of written notice, the non-breaching party may terminate with immediate effect.
  • Force majeure: Neither party is liable for delays or non-performance due to circumstances beyond reasonable control — including acts of God, war, natural calamities, strikes, or government action.

11. Holidays and Working Hours

Our office is open Monday to Saturday, 10:30 AM to 8:30 PM. Deliveries scheduled around the following holidays will be rescheduled in consultation with the client:

  • Dasara
  • Ganesh Chaturthi
  • Diwali
  • Any unforeseen circumstances such as strikes or natural calamities

12. Contract Validity

The signed contract between Austins and the client is valid for 6 months from the date of signing, after which it stands null and void. If the project continues beyond this duration, the contract must be renewed in writing.

It is understood that the contents of the contract are agreed upon by both the client and the architect, regardless of whose signature is affixed to the document.

13. Jurisdiction and Governing Law

These terms are governed by the laws of India. Any dispute arising out of or in connection with these terms will be subject to the exclusive jurisdiction of the courts at Bangalore, Karnataka.

14. Final Words

These terms exist to make your engagement with us clear, transparent, and free of friction — so that the focus stays where it should be: on the craftsmanship, the conversation, and the piece you’ll live with for years.
